1. Governing Law and Jurisdiction

2. Terms of the Agreement

Access to the Service is subject to Cybyte LLC's acceptance of your request. Until confirmed, no agreement exists, and you are not entitled to access or rights to the Service. Cybyte LLC may revise or update this Agreement at its sole discretion without prior notice.

Amendments take effect immediately upon publication on the Website or communication via other means. Continued use of the Service or Website constitutes acceptance of the revised terms. If you do not agree with the changes, you must discontinue use of the Service and Website.

Cybyte LLC reserves the right to decline any application or request for access to the Service at its sole discretion, without obligation to provide a justification.

3. Billing Terms

The monthly subscription begins immediately upon sign-up for a fee of $39.99 and renews automatically every 30 days unless cancelled. If you do not unsubscribe, the Service will automatically renew on a monthly (30 days) basis and you as the user give permission for a monthly charge/fee of $39.99. In the event of an unsuccessful recurring payment, Cybyte LLC reserves the right to apply a discounted membership rate, allowing you continued access to the Service. If this discounted rate cannot be processed successfully, an administrative fee of up to $3.00 may be applied to maintain your subscription until the full or discounted subscription fee is successfully processed.

Cybyte LLC is not responsible for issues related to your payment method. Any disputes must be resolved directly with your payment provider. All payments must be made using legitimate funds. Users are responsible for any browsing or data fees incurred while using the service.

4. Member Support

To access the Services, your device must meet the platform's minimum requirements, including internet access and compatible software. Cybyte LLC provides assistance for Member Users, including troubleshooting and periodic updates, call +1 833 382-3674 between Daily 8:00am to 8:00pm, EST, US Eastern time.. Additional equipment or services may be required, and Cybyte LLC is not obligated to offer support beyond what is outlined in these Terms.

5. Refund Policy

Any refunds owed to you, minus any applicable deductions, will be processed promptly and no later than 14 days after you notify us of your decision to cancel the Service. Refunds will be issued using the original payment method unless otherwise agreed.

Refund requests must be submitted within 30 days of sign-up. These refund provisions do not affect your statutory rights.

Once processed, refunds typically take 3-5 business days to appear on your card.

6. User Responsibilities

By using the Services, you agree to adhere to the following terms. The Services are intended for lawful, personal, and non-commercial use only. You will not:

Violate the intellectual property, privacy, or other rights of any individual or entity.
Promote or encourage illegal or harmful activities.
Use unauthorized methods to access, distribute, or interfere with the Content or Services.
Employ automated tools, such as bots or scripts, to access or manipulate the Services.
Introduce harmful software, disrupt functionality, or gain unauthorized access.
Remove, disable, or alter advertising, security features, or any functionality associated with the Services.
Collect personal data in violation of Cybyte LLC's Privacy Policy.

You agree to use the Content for personal use only and will not copy, distribute, or alter it, nor attempt to bypass any security measures associated with it.

7. Terms of the Agreement

No contract or agreement is formed, and you have no rights to the Service unless and until Cybyte LLC explicitly agrees to provide you access to the Service.

Cybyte LLC reserves the right to amend or modify this Agreement at any time without prior notice. Changes take effect immediately upon being posted on the Site or upon Cybyte LLC notifying you through other means.

By continuing to use the Site or Service after such amendments or modifications are posted or communicated, you signify your acceptance of the revised Agreement.

If you do not agree to the updated terms, you must cease using the Site and the Service. We may refuse any application to use the Services for any reason whatsoever.

12. Content Ownership and Usage Rights

13. Service Termination

Users have the right to terminate their subscription at any time, starting from the date of registration. If cancellation occurs after billing has commenced, the subscription will be deactivated immediately, but the account will remain active until the end of the current prepaid period. To initiate cancellation, users may go to their account settings and select the cancellation option, or contact Cybyte LLC using the details provided at the bottom of the website.

Cybyte LLC reserves the right to modify, suspend, terminate, or discontinue the Service or this Agreement at any time, in whole or in part, temporarily or permanently, for any reason or no reason, with or without prior notice, and without liability.

Grounds for termination include, but are not limited to, failure to pay subscription fees, inactivity, use of multiple or unauthorized free accounts, non-compliance with these Terms, or platform maintenance and updates.

For Paid Users, unless there has been a breach of this Agreement, any material changes that negatively affect the Service or the suspension/termination of the Service will generally take effect at the end of the current billing period. However, Cybyte LLC reserves the right to immediately terminate or suspend the Service and may issue a prorated refund for any unused portion of the billing cycle.

By continuing to use the Service after such changes, you waive any claims for additional refunds.

14. Consequences of Termination

Upon termination, cancellation, or discontinuation of the Site or Service, your right to access and use the Site or Service will cease as specified.

You will no longer have access to your account, including any files or content stored within it. However, Cybyte LLC may retain such content at its discretion.

Termination, suspension, or cancellation of the Service does not release you from any obligations outlined in these Terms. Certain provisions of these Terms, including but not limited to those relating to ownership rights, indemnification, and limitations of liability, will remain in effect and enforceable even after termination.

15. Service Suspension and Changes

Cybyte LLC reserves the right to modify, suspend, or discontinue some or all Services (including Content or supported devices) at any time, whether temporarily or permanently, and without prior notice. These decisions are made at Cybyte LLC's sole discretion, and you agree that Cybyte LLC will not be liable for any resulting impact on your use of the Services.

At its discretion, Cybyte LLC may offer compensation, such as credits or refunds, for disruptions. However, no compensation will be provided if the suspension or discontinuation results from your violation of these Terms.

16. Additional Actions

In the event of a breach of this Agreement, Cybyte LLC may, at its sole discretion, take any actions it deems necessary or appropriate, in addition to or as an alternative to terminating or suspending your access to the Site or Service. These actions may include, but are not limited to:

Suspending or deactivating your account
Blocking your IP address or restricting access to the Site or Service
Employing other technical measures to enforce compliance
Taking legal action as permitted under applicable laws

Cybyte LLC reserves the right to determine the appropriate course of action based on the nature and severity of the breach.

17. Unforeseeable Events

Cybyte LLC will not be held responsible for any failure or delay in fulfilling its obligations due to circumstances beyond its reasonable control. Such events may include, but are not limited to, denial-of-service attacks, strikes, riots, natural disasters, acts of war, terrorism, governmental actions, labor disruptions, internet outages, or other extraordinary events (each referred to as a "Force Majeure Event").

During a Force Majeure Event, Cybyte LLC is relieved of its obligations for the duration of the event and any additional time reasonably needed to recover from its effects.

18. Intellectual Property Rights

You acknowledge that certain Content is owned by third-party licensors. These licensors maintain the right to directly enforce the provisions of these Terms against you and pursue any legal remedies as applicable. These licensors retain the right to enforce applicable provisions of these Terms against you directly, in addition to pursuing any other legal rights or remedies available to them.

19. No Warranties Provided

You acknowledge and agree that your use of the Site and Service is entirely at your own risk. Cybyte LLC provides the Service "as is," without any guarantees, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Cybyte LLC does not guarantee that the Service will meet your expectations, function without interruption, or be free of errors, viruses, or other harmful components. Any material you download or access through the Service is at your own discretion and risk, and you are responsible for any resulting damage or data loss.
